Changes to the EU Trademark Regulation

The EU Trademark Regulation has been unclear if the European trademark licensee could take enforcement actions against third parties.

By Judgement of 4 February 2016, it was confirmed that the licensor’s consent to enforce the trademark was sufficient, irrespective of the fact whether the license was registered or not. The Judgement finally clarifies a practical aspect of European trademark litigation, while it not only guarantees the licensee’s trademark rights but also safeguards the interest of the trademark holder.
